New York Electricity Service
New York offers a deregulated electricity service market to their residents. After New York state deregulated their electricity market it caused electricity rates to come down among all the electric providers in the state. Prior to deregulation there were only the monopoly utility companies selling electricity service. New York residents had no choice in picking a cheaper electricity service company. Now people in New York do not have to use the old monopoly companies like Coned. ConEd is a great electricity company but I think even ConEd can agree that electricity choice will only make things better for their customers and for ConEd. For instance, Con Edison has taken deregulation as an opportunity to enter other deregulated states like Texas to sell their electricity service. Deregulation will also make old utility companies like ConEd to become more inovative and customer focused.
History of Electric Competition in New York
The organization responsible for opening up New York state to electricity competition is the New York State Public Service Commission (PSC). In comparison the Public Utility Commission of Texas opened electricity deregulation up in Texas. Just like in Texas, New York residents and businesses can choose their electricity supplier.
In Texas the Electric Company is referred to as the "Electricity Provider" but in New York the official documentation lists electricity companies as "Energy Suppliers" or "ESCOS". Even though you can pick a competitive electricity company known as an "Energy Supplier" in New York you will still have your electricity delivered to your home or business by the monopoly local utility company. The utility company power outage phone number will continue to appear on your New York electricity bill.
It is important for the New York electricity consumer to be aware of the state regulatory agency that controsl deregulation in New York. The New York State Public Service Commission regulates and controls the deregulated market and electricity grid. This regulatory agency is also known as the PSC in short and approves and and all electricity utility plans that give electric customers access to new energy suppliers known as energy service companies, or "ESCOs." By having ESCO's offer electricity choice to New York state residents it continues to help reduce the overall cost of electricity service and offer different prices and plans.
In a competitive New York electricity market, New York electricity rates continue to be lower than they would be under government regulation because of the force of competition among multiple electric companies lowering rates. This new electricity service competition has also helped to produce better rate plans and choices like the short term 3 month fixed rate or an electricity rate that locks in your electricity price during the summer but allows it to fluctuate during off peak seasonal periods.
Electricity Savings
The state government of New York has provided a lot of good consumer information about electricity rates and companies but cannot make you read it. It is important to go out to the The New York State Public Service Commission website and read up on rate plans, rules, and terms of service information. When deciding on an electricity supplier in New York we recommend looking through the facts label and terms of service. Look for the pricing line item and try and find anything that may cause the advertised rate to go up in price for some vague or undefined reason. If the contract is written so the price can change than we recommend not signing up with that New York electricity company as you will likely not save money once they raise your electricity rate on you mid way through the energy contract.
What Remains the Same? What Will Change?
Your current utility which delivers the electricity service through the poles and wires will still deliver your electricity as they always have. This should be a given as if there were 50 retail energy suppliers to choose from and they were all the utility also you would have 50 wires running to your house from the pole outside. This is the obvious reason why the utility must always remain a monopoly and regulated by the government as it is impossible to run that many lines and would be unprofitable. You can still buy power from the monopoly utility but you will not save money by picking the most competitive supplier. The utility power outage phone number will still appear on your electricity bill regardless of the energy company you choose.
A New York competitive electricity supplier may offer additional rate plans and services your old utility never provided. Why do the new companies offer more choices when choosing an electricity rate? They have an incentive to do so because they have to work to earn your business. By providing short and long term fixed rate they give you more choices in how to control the price of your electricity. Have you ever seen your old utility go up and wanted to protest but couldn't because they were your only choice? You can now protest and switch electricity companies to the cheapest New York electricity company.
Protections
The PSC requires that ESCOs offer reasonable customer protections, such as:
- a statement disclosing the Energy Service Companies complaint resolution process
- a 15-day notice before discontinuing service
- customer choice of service from another Energy Service Company or the utility when an ESCO (Energy Service Company) discontinues service
- clear procedures for switching suppliers
- convenient complaint handling
- Energy Service Companies serving residential electricity customers must comply with the Home Energy Fair Practices Act (HEFPA) and PSC (Public Service Commission) orders regarding payment allocation methods.
You may contact the PSC (Public Service Commission) to register a complaint about an Energy Service Company. Upon receipt, the Public Service Commission will forward the complaint to the ESCO for resolution. The PSC has the authority to revoke an ESCO's eligibility to do business if an excessive number of legitimate complaints against the ESCO are received. In Texas for example, Riverway Power and National Power Company received multiple complaints from customers because their fixed electricity rates were changing to a higher price. The Texas Public Utility Commission of Texas which is like the New York Public Service Commission took Riverway and National Power off their state website and told those companies they could not change their fixed rate. Riverway and National Power had to give up their customers to what Texas calls the "Provider of Last Resort" The POLR company can be any approved competitive retail electric provider and is available to take on any new customers that were dumped by a bankrupt or no longer doing business electricity provider to insure electricity service constinues with no interuption.
Billing
One of the most common confusion for a New York electricity customer is billing. The confusion comes in the form of bundled and unbindled electricity rates. An electricity company in New York may advertise a rate that doe snot include the utility charges. This makes their electricity rate look artificially lower than electric companies that advertise a total bundled electricity price that includes all utility charges. A straight forward electricity rate in New York becomes a bit of challenge to understand and find when you have some providers advertising and billing one way and othere competitve electricity providers advertising and billing in a different manner.
One way to verify that you are being billed correctly by a competitive electricity supplier in New York that bundled in the utility charges is to request your utility electricity usage data. The utility is required to release this usage data to the customer. You can look at the usage data and the utility cost. Then pull out your electricity provider bill and look for the utility chharges line item. If the competitve electricity provider has a higher cost shown under the utility line item they are adding bogus profit margins to the utility portion of the bill. The reason I say, "bogus" is because all that the Electricity company does in regards to utility charges is pass them through on the bill. They are not generating or delievring this electricity so there should not be additional retail margin added to this charge.
Whether you choose to buy power from your utility or an ESCO, your bill for electricity will separate (unbundle) charges. If you choose an ESCO, you may receive two bills: one bill from the ESCO for electricity supply and other products it sells to you, and one from the utility for transmission and delivery charges. Other options are possible -- the utility may bill you on behalf of the ESCO and include the ESCO's charges in its bill, or the ESCO may bill you on behalf of the utility and include the utility's charges in the ESCO's bill.
Regardless, you will always have access to your usage and billing history, and that information can only be released by the utility with your permission.
Safety and Reliability
The safety and reliability of the New York electricity delivery system is the job of the energy utility. It will maintain the lines and repair them if there is an outage or storm. The PSC will also ensure that a safe and reliable electricity delivery system exists, through continued regulation of this portion of the power industry.
In addition, the electricity utility company is known as the provider of last resort just as it is in Texas with a small difference. In Texas any competitive electricity company can be the provider of last resort if they have been approved by the PUCT. In New York that POLR company can only be the old monopoly utility that used to also sell you electricity service. For example, should your ESCO go out of business, the utility will make sure you continue to receive power. Or, if you decide to switch back to the utility, or switch ESCOs, there will be no interruption in service when you change.
Choosing an ESCO
If you want to shop for a different electric supplier, you should first find out from your New York electricity utility if this option is available in your area. Not all areas in New York are deregulated at this time unfortunately but this is slowly changing. You can obtain a list of ESCOs eligible to provide service in New York State from your utility or the PSC.
Most importantly before you sign an energy contract with a Competitive Energy Service Company in New York, you should do the following:
- Compare electricity prices and services offered.
- Review terms of any written agreements that may be required. These terms may cover special fees, deposits, renewals and switching procedures.
- Consider customer service features including complaint handling, hours of operation, and toll-free numbers.
- Evaluate billing and payment options.
- Research the company's background. You may want to know how long the company has been in business, the company's location, if it is affiliated with a utility or any other company, and whether your account information will be kept confidential.

It's freakishly odd how hard it is explain the energy market of NY, nicely done.
Family and friends of mine have energy with Ambit an ESCO in NY since 2007.
